Terms of Service

1. The Service

DishMotion lets your restaurant publish a video menu that guests open by scanning a QR code, accept orders and online payments from guests, and produce short dish videos, including with AI tools.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, timely, or error-free.

2. Accounts

You register with a work email address and sign in with a one-time code. You must be authorized to act on behalf of the restaurant you register.

You are responsible for all activity under your account, including the actions of staff members you invite, and for keeping access to your email account secure.

3. Subscription and billing

The Service is offered on a Free plan and on a Pro plan at $100 per month. The Pro subscription renews automatically each billing period until cancelled.

You can cancel at any time; the subscription stays active until the end of the current billing period. Fees already paid are non-refundable, except where a refund is required by law. We may change prices with advance notice; the new price applies from the next billing period.

4. AI video generation and prepaid balance

AI video generation is a paid add-on: $1 per generated clip, charged from a prepaid balance that you fund in advance.

The prepaid balance is non-refundable and does not expire while your account is active. Generated clips are provided as-is; you are responsible for reviewing each clip before publishing it to your menu.

5. Guest payments and Stripe

Online payments from your guests are processed by Stripe, which acts as the payment processor. Card data is collected and stored by Stripe, not by us. By enabling online payments you also agree to Stripe's terms and requirements.

We charge 0% platform commission on orders: you receive the amount your guest pays, minus Stripe's processing fees. Payouts, refunds, and chargebacks are handled through your Stripe account and are subject to Stripe's rules.

6. Your content and your responsibility

You are solely responsible for everything you publish through the Service: menu items, descriptions, prices, taxes, allergen information, photos, and videos. Prices shown to guests are set by you and are binding on you.

You warrant that you own or have the rights to all content you upload, and that your content and your use of the Service comply with applicable law, including food-safety, labeling, consumer-protection, and licensing rules.

7. Acceptable use

You may not use the Service for anything unlawful, to publish content that infringes third-party rights, to mislead guests, or to interfere with or probe the Service, its infrastructure, or other users' data.

8. Termination

You may close your account at any time. We may suspend or terminate an account that violates these Terms or creates risk for us, guests, or third parties.

When an account is terminated, its menus stop being served to guests. We handle the data that remains as described in the Privacy Policy.

9. Limitation of liability

To the maximum extent permitted by law, DishMotion is not liable for indirect, incidental, special, or consequential damages, lost profits, lost revenue, or lost data arising from your use of the Service.

Our aggregate liability for any claims relating to the Service is limited to the amounts you paid us in the twelve months preceding the event giving rise to the claim.

10. Changes to these Terms

We may update these Terms from time to time. We will announce material changes by email or inside the Service before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
